When purchasing property on Ibiza, it is often assumed that existing buildings are automatically legal. This assumption is not always correct. Many properties on the island include structures, extensions or uses that do not fully comply with current planning regulations. For buyers, this can result in significant legal and financial risks.

A property is considered legal when all buildings and components have been constructed in accordance with valid building permits and when the existing structure matches the approved plans. This includes not only the main building but also swimming pools, terraces, extensions, garages and outbuildings. Even minor deviations can be legally relevant.
Illegal properties or elements are those built without proper authorisation or used in a way that differs from the approved purpose. Common examples include unauthorised extensions, enclosed terraces, additional residential units or changes in use from storage to living space. Older buildings are not automatically legal if no permits can be documented.
A key risk is that illegal constructions cannot always be legalised retroactively. Depending on zoning, land classification and current regulations, legalisation may not be possible. This can lead to usage restrictions, fines or, in severe cases, demolition orders. In addition, issues may arise when connecting utilities, renting the property or selling it in the future.
It is also important to distinguish between time-barred and non-time-barred infringements. In some cases, older unauthorised structures may be tolerated but not legally recognised. Such tolerance does not provide full legal security, particularly when ownership changes.
A thorough legal review is therefore essential. This includes examining building permits, approved plans, cadastral records and, where necessary, obtaining professional legal and technical advice. Only through careful due diligence can buyers accurately assess which parts of a property are legally compliant.
A clear and objective evaluation helps avoid unexpected consequences and is fundamental to a secure property purchase in Ibiza.
