Purchasing property in Ibiza is not only a financial commitment but also a legal one. One of the most important steps in ensuring a secure transaction is the thorough review of all relevant documentation. Missing, incomplete or inconsistent documents can lead to significant legal and financial risks and should be clarified before signing any contract.

One of the key documents is the land registry extract (Registro de la Propiedad). It confirms the legal owner of the property, lists any existing encumbrances such as mortgages, rights of way or usufructs, and provides the official legal description of the asset. Only the information registered in the land registry is legally binding, making this document essential.

In addition, the cadastral record (Catastro) is crucial. It reflects the physical reality of the property, including plot boundaries, surface areas and building structures. On Ibiza, discrepancies between the land registry, cadastral records and the actual condition of the property are relatively common. Identifying and resolving these inconsistencies before purchase is highly advisable.

Another important document is the building permit (Licencia de Obra). It confirms that the property and its components were constructed legally. This is particularly relevant for older properties, where extensions, pools, terraces or outbuildings may not always have been authorised. Unapproved structures can result in usage restrictions or penalties.

The habitation certificate (Cédula de Habitabilidad) is equally important. It certifies that the property meets the minimum legal standards for residential use. Without a valid certificate, difficulties may arise when connecting utilities or renting the property.

Additional required documents include the energy performance certificate, up-to-date tax payment records, and, in the case of apartments, documentation from the homeowners’ association. A complete and verified set of documents is essential for a legally secure property purchase in Ibiza.
